Effective January 1, 2026

1. Acceptance of Terms

1.1 By accepting a service proposal from Newell Services, LLC (“the Company”), you (“Client”) agree to be bound by these Terms and Conditions. If you do not agree with any part of these terms, please refrain from using our services.

2. Services Definition

2.1 Services provided by Newell Services, LLC may include, but are not limited to:

Lawn care services (fertilization, weed control, overseeding, turfgrass establishment, soil aeration, disease treatment, microbial and fungal applications)
Specialty services (soil testing, topdressing, leveling, outdoor pest control)
Landscape design and installation services
Mulch installation, planting, and landscape cleanouts

3. Invoicing & Payment Policy

3.1 Fees

Client agrees to pay all fees as outlined in approved service proposals.

3.2 Payment Requirement

Acceptance of a service proposal is contingent upon one of the following:

A valid payment method stored on file with Auto-Pay authorization, including any required down payment, or\n
Full annual prepayment during the annual prepay window (November 1 – December 31)

3.3 Ongoing Validity of Payment Method

For Auto-Pay accounts, the Client must maintain a valid, active payment method on file at all times. Removing or disabling the stored payment method constitutes a breach of these Terms and may result in immediate suspension or termination of services until a valid method is restored.

3.4 Past Due Invoices

Invoices not paid when due will result in suspension of services until the outstanding balance is satisfied.

3.5 Late Fees

A late fee of 4% of the outstanding invoice balance will be assessed every 30 days after the due date until the balance is paid in full.

3.6 Collections and Recovery Costs

In the event of nonpayment requiring collection efforts, the Client agrees to pay all reasonable attorney’s fees, court costs, and collection agency fees incurred by the Company.

4. Reschedule Policy

4.1 Submission Method

All reschedule requests must be submitted using the official Company form:

4.2 Deadline

Requests must be received by 6:00 a.m. local time on the scheduled service day.

4.3 No Access

If service personnel cannot access the property, the Client remains responsible for the scheduled service fee. The Company will reschedule the service at its next available opportunity based on routing efficiency and scheduling availability.

4.4 Reschedule Fee

A $10 reschedule fee applies to requests received after the deadline or when service cannot be completed due to no or limited access.

4.5 Scheduling Availability

Rescheduled services are performed at the Company’s convenience. Preferred times may be requested but are not guaranteed.

4.6 Exceptions

The Company may waive reschedule fees in emergency situations or other exceptional circumstances at its discretion.

5. Service Termination Policy

5.1 Client Cancellation

Clients may cancel services by submitting the official cancellation form at least seven (7) days prior to the next scheduled service:

5.2 Outstanding Balances

Cancellation does not relieve the Client of responsibility for any outstanding balances.

5.3 Breach of Terms

The Company reserves the right to terminate services immediately if the Client breaches these Terms and Conditions.

5.4 Abuse or Harassment

Services may be terminated if property owners, neighbors, or guests threaten, harass, or abuse Company staff or representatives.

6. Refund Policy

6.1 Eligibility

Refunds may be considered only for:

Services not completed due to circumstances beyond the Client’s control
Proper cancellation in accordance with Section 5.0 (prepaid amounts less outstanding balances and non-refundable items)

Dissatisfaction with results is not grounds for a refund.

6.2 Request Process

Refund requests must be submitted promptly and may require supporting documentation.

6.3 Refund Method

Approved refunds are issued by paper check mailed to the billing address on file and processed within 30 days of approval. Any promotional discounts will be reversed.

7. Liability & Insurance

7.1 The Company is not liable for damages caused by factors beyond its control, including but not limited to weather, acts of nature, pets, wildlife, or undisclosed underground utilities or obstacles.

7.2 The Company maintains all required insurance coverage and Oklahoma Department of Agriculture, Food, and Forestry (ODAFF) licensing. Clients are encouraged to maintain adequate property insurance.

8. Force Majeure

8.1 Lawn care results depend on weather and cultural practices; no guarantees are made regarding final outcomes.

8.2 The Company is not liable for service interruptions caused by events beyond reasonable control, including weather events, natural disasters, government action, labor disruptions, or other force majeure events.

8.3 No refunds or credits will be issued for delays or interruptions resulting from force majeure events.

9. Privacy Policy

9.1 The Company collects Client information solely for service delivery, billing, communication, marketing (opt-out available), and legal compliance.

9.2 Personal information is not sold and is safeguarded using reasonable security measures.

9.3 Information is retained only as long as necessary for service delivery and legal requirements.

9.4 Services are not directed to individuals under the age of 18.

10. Discounts Policy

10.0 Effective January 1, 2026, Newell Services, LLC does not offer service discounts.

10.1 Referral Rewards Program (Lead-Acquisition Credit)

Referral incentives are issued as invoice credits, not cash or discounts
Credits apply only after the referred client’s first invoice is paid
Credits may be applied to future invoices and have no cash value
Program structure may be modified, suspended, or discontinued at any time

11. Client Responsibilities

Clients are responsible for:

Providing safe and timely access to the property
Keeping people, pets, and guests off treated areas until reentry is permitted
Maintaining irrigation, mowing, and cultural practices in accordance with Company guidance and Oklahoma State University Extension recommendations
Disclosing underground utilities, irrigation systems, invisible fences, or other buried items

Failure to comply may impact service results and liability.

12. Results Disclaimer

The Company does not guarantee specific turf or plant outcomes due to factors beyond its control, including weather, soil conditions, pest pressure, prior treatments, or maintenance practices.

13. Chemical Use & Safety

All products are applied in compliance with applicable laws and regulations. Clients must follow posted signage and reentry instructions. The Company is not responsible for exposure resulting from early reentry.

14. Photo & Testimonial Use

The Company may photograph serviced properties for documentation, training, historical reference, and marketing purposes. Reasonable steps will be taken to avoid disclosure of sensitive personal information.

15. Severability

If any provision of these Terms and Conditions is found to be invalid or unenforceable, all remaining provisions remain in full force and effect.

16. Governing Law & Venue

These Terms and Conditions are governed by the laws of the State of Oklahoma. Any disputes shall be resolved in the courts of Osage County, Oklahoma.

17. Changes to Terms

The Company may update these Terms and Conditions at any time. Continued use of services constitutes acceptance of the most current version.
